The Ministry of Communication and Information urges all private sector Electronic System Operators (PSE) to immediately register their electronic systems with Kominfo.
Director of Information Application Management at the Ministry of Communications and Information Technology, Mariam F. Barata, emphasized that private sector PSEs, especially the tourism and creative economy sectors that meet the criteria in accordance with statutory provisions are required to register no later than 6 months after the implementation of risk-based business licensing becomes effective.
"We give 6 months so that the registration period is long, so that there is no accumulation of registrants," he said, quoted on Tuesday (22/6/2021).
"We hope that (Private Scope PSE) from the Tourism and Creative Economy sector will immediately register, because this is an obligation. We see many travel sites, for example, that have not registered yet,” he continued.
He also said that PSE has a content moderation function to comply with the legislation. For example, do not create content that disturbs the public and disturbs public order.
"If there is a violation, the Minister (Kominfo) can order PSE to terminate access (takedown)," he said.
Furthermore, Mariam also emphasized that PSEs in all sectors are required to cooperate with law enforcement if there are handling cases of violations.
"If there is a violation, then PSE is obliged to provide access to law enforcement to handle it," he said.
Losses Not Protecting IPR

Meanwhile, Deputy for the Digital Economy and Creative Products, Ministry of Tourism and Creative Economy, Muhammad Neil El Himam regarding the PSE in the tourism sector, he reminded that Intellectual Property Rights (IPR) need to be protected because they involve economic and legal aspects. The disadvantage is that if you do not protect intellectual property rights, your intellectual creations are free to be used and commercialized by other parties
“If it is not protected, intellectual property rights can be used by other parties. The creator or original author has to pay a fee for his own creation," he explained.
Regarding the registration of Private Scope PSE, the Traveloka Application is an example of a private scope of PSE that has already registered. This application is engaged in the business of web portals and tourism bureaus that provide online ticket reservation services, hotels, beauty and health services. Traveloka also serves financial transactions such as paylater.
General Counsel of Traveloka Group Companies, Dimas Nandaraditya said PSE registration is very easy. In accordance with Article 6 of PP 71/2019, his party registered the electronic system and submitted it to the Minister of Communication and Information.
“Traveloka was one of the first to register. We appreciate Kominfo's efforts to socialize business actors to register PSE," he said.
"Registration is also easy, the interface is user friendly, the flow and document requirements are clear and there is a consultation and complaint forum," he said.
